DEVICE REPAIR TERMS & CONDITIONS
Wizard House Pty Ltd — Trading as Wizard House IT
These Device Repair Terms & Conditions apply whenever a customer leaves, provides or otherwise authorises Wizard House IT to inspect, diagnose, repair, service, configure, upgrade or otherwise work on a device.
By signing these Terms & Conditions, the customer acknowledges and accepts the conditions below and authorises Wizard House IT to perform the agreed services.
1. Repair Authorisation
The customer authorises Wizard House IT to inspect, diagnose and perform the services requested or otherwise approved by the customer.
Where additional work, parts or costs are identified during diagnosis, Wizard House IT may contact the customer for further approval before proceeding.
The customer confirms that they are the owner of the device or are otherwise authorised by the owner to approve work on the device.
2. Diagnostic & Assessment Fees
Diagnostic, assessment and labour charges may apply even where:
- The customer chooses not to proceed with a recommended repair.
- The device is found to be uneconomical or impractical to repair.
- No fault can be reproduced or identified.
- The fault is caused by software, configuration, third-party services or circumstances outside the control of Wizard House IT.
- Parts required to complete the repair are unavailable.
Any applicable diagnostic or assessment charges will be communicated in accordance with our normal service process.
3. Estimates & Additional Work
Any estimate provided before or during diagnosis is based on the information available at that time.
Additional faults may become apparent once the device is opened, tested or further diagnosed.
Wizard House IT will seek customer approval before carrying out additional chargeable work that materially exceeds the agreed scope or estimate.
4. Repair Timeframes
Any completion date or timeframe provided is an estimate unless expressly agreed otherwise in writing.
Repairs may be affected by:
- Parts availability.
- Supplier or freight delays.
- Manufacturer requirements.
- Additional or previously unidentified faults.
- Software or operating system issues.
- Warranty procedures.
- Circumstances outside the reasonable control of Wizard House IT.
Wizard House IT will make reasonable efforts to complete services within the estimated timeframe.
5. Data & Backup Responsibility
Electronic device diagnostics and repairs may involve an inherent risk of data loss, corruption or inaccessibility.
Customers are responsible for maintaining an appropriate backup of important data before submitting a device for service wherever reasonably possible.
Wizard House IT will exercise reasonable care when handling customer devices and data but cannot guarantee that data will be preserved or recoverable.
Diagnostics or repairs may require operating system repair, reset, reinstallation, drive replacement, malware removal or other procedures that may alter or remove stored data.
Nothing in this section excludes or limits any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
6. Data Loss Repair Notice
The customer acknowledges that the device may contain user-generated data, including documents, photographs, videos, emails, settings or other files.
Where the requested repair or diagnostic process may result in the loss of user-generated data, the customer acknowledges this risk before the repair is undertaken.
Where preservation of particular data is essential, the customer must advise Wizard House IT before work commences.
7. Data Recovery
Data recovery is performed on a best-efforts basis unless otherwise expressly agreed.
Wizard House IT does not guarantee that lost, deleted, corrupted or inaccessible data can be recovered.
Where data recovery is requested, the customer acknowledges that:
- Recovery may be partial or unsuccessful.
- File names, folder structures or metadata may not be preserved.
- Storage media may deteriorate or fail further during diagnosis or recovery attempts.
- Additional specialist recovery services may be recommended where appropriate.
Any applicable data recovery charges will be communicated to the customer.
8. Passwords & Device Access
The customer may be required to provide passwords, PINs or other access information necessary to diagnose, test or repair the device.
The customer authorises Wizard House IT personnel to access the device only to the extent reasonably necessary to perform the requested services, testing and verification.
Customers should not provide passwords for services or accounts that are unnecessary for the requested work.
Where appropriate, customers may change passwords after the service has been completed.
9. Privacy & Customer Information
Wizard House IT will handle personal information in accordance with applicable privacy requirements and our Privacy Policy.
During diagnostics or repair, technicians may incidentally encounter personal files or information stored on the device. Access to such information will be limited to what is reasonably necessary to perform the requested service.
Customer information will not be intentionally accessed, copied or disclosed for purposes unrelated to the service, except where required or authorised by law.
10. Malware, Viruses & Security Threats
Malware and security-related services are performed on a best-efforts basis.
Wizard House IT cannot guarantee that:
- Every malicious file or threat will be detected.
- A device will remain free from future infection.
- Third-party security software will detect every threat.
- Malware removal will not affect damaged or infected files, applications or system settings.
Future infections caused by websites, downloads, email attachments, compromised accounts, customer actions or newly emerging threats are not considered a failure of the original service.
11. Software & Operating Systems
Wizard House IT will exercise reasonable care and skill when providing software and operating system services.
However, we cannot guarantee the ongoing operation of software, operating systems or third-party services following future:
- Updates.
- Upgrades.
- Manufacturer changes.
- Driver changes.
- Customer configuration changes.
- Third-party software installations.
- Malware infections.
- Account or licensing changes.
Software licences remain subject to the terms imposed by their respective publishers or providers.
12. Pre-Existing Faults & Physical Condition
The customer acknowledges that devices may have pre-existing damage, deterioration or faults that are not immediately visible.
This may include:
- Cracked or weakened plastics.
- Damaged hinges.
- Loose connectors.
- Worn batteries.
- Corrosion.
- Previous liquid exposure.
- Previously repaired components.
- Failing storage devices.
- Heat damage.
- Internal physical damage.
Opening, testing or handling a device may reveal or aggravate a pre-existing weakness that could not reasonably have been identified beforehand.
Wizard House IT will exercise reasonable care when handling customer equipment.
13. Liquid-Damaged Devices
Liquid-damaged devices are inherently unpredictable.
Corrosion and electrical damage may continue to develop after the initial exposure, and successful repair cannot be guaranteed.
A device that operates following treatment may subsequently develop additional faults.
Any repair or cleaning of a liquid-damaged device is therefore undertaken on a best-efforts basis, subject always to the customer's rights under Australian Consumer Law.
14. Replacement Parts
Replacement parts may be:
- Genuine manufacturer parts.
- OEM-equivalent parts.
- Refurbished parts.
- Compatible third-party parts.
The type of part used will depend on availability, customer requirements, manufacturer restrictions and the agreed repair.
Where reasonably practicable, customers will be informed when a materially different type of replacement part is proposed.
Parts supplied by Wizard House IT are covered by any applicable manufacturer or supplier warranty and by any rights available under Australian Consumer Law.
15. Customer-Supplied Parts
Where Wizard House IT agrees to install a part supplied by the customer, the customer accepts responsibility for the suitability, compatibility and condition of that part.
Wizard House IT does not provide a warranty against defects inherent in customer-supplied parts.
However, this does not affect any rights the customer may have in relation to the installation service itself.
Additional labour charges may apply if a customer-supplied part is incompatible, defective or requires additional work.
16. Repair & Workmanship Warranty
Unless otherwise specified, Wizard House IT provides a 90-day workmanship warranty on repair labour performed by us.
The workmanship warranty applies to faults directly attributable to the original repair work.
It does not cover unrelated faults or subsequent problems caused by:
- Accidental or physical damage.
- Liquid exposure.
- Malware or security incidents.
- Customer modification.
- Third-party repair or modification.
- Misuse.
- New hardware failure.
- Software or operating system updates.
- Issues unrelated to the original repair.
This workmanship warranty is provided in addition to, and does not limit, any rights or remedies available under Australian Consumer Law.
17. Manufacturer Warranty
Work performed by Wizard House IT may affect a manufacturer's warranty depending on the manufacturer's terms and the nature of the repair.
Where manufacturer warranty coverage may be relevant, customers should advise us before authorising third-party repair work.
Wizard House IT does not control manufacturer warranty decisions and cannot guarantee that a manufacturer will accept a subsequent warranty claim.
Nothing in this section affects rights that cannot lawfully be excluded under Australian Consumer Law.
18. Uncollected Devices
Customers will be notified when their device is ready for collection or when further action is required.
Customers are responsible for collecting their equipment within a reasonable period after notification.
Where a device remains uncollected, Wizard House IT may issue additional notices and may charge reasonable storage or administration fees where permitted by law and where the customer has been appropriately notified.
Any disposal, sale or other action involving uncollected goods will only occur in accordance with applicable law.
19. Limitation of Liability
To the maximum extent permitted by law, Wizard House IT is not responsible for indirect or consequential loss arising from circumstances outside its reasonable control.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
Where the law permits liability to be limited, any limitation will apply only to the extent permitted by law.
20. Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts or modifies any rights, guarantees or remedies available to consumers under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
Our goods and services come with consumer guarantees that cannot be excluded under Australian Consumer Law.
Where goods or services fail to comply with an applicable consumer guarantee, the customer may be entitled to a repair, replacement, refund, re-supply of services, cancellation and/or compensation, depending on the circumstances and as provided by law.
Terms & Conditions of Sale
1. Payment Terms
Unless otherwise agreed in writing, all invoices issued by Wizard House Pty Ltd are Pay on Receipt.
Ownership of goods remains with Wizard House Pty Ltd until payment has been received in full.
Special orders, custom-built systems, deposits, and certain services may require full payment before ordering, commencement of work, or collection.
Accepted payment methods are determined by Wizard House Pty Ltd and may change from time to time.
2. Overdue Accounts & Debt Recovery
Invoices not paid by the due date may be subject to:
- Reminder notices by email, SMS, telephone, or post.
- Suspension of services or future credit facilities.
- Refusal of future special orders or services until outstanding balances are cleared.
Accounts remaining unpaid 30 days after the invoice date may incur a monthly overdue administration fee of $20.00.
Accounts remaining unpaid for an extended period may be referred to a debt recovery agency, solicitor, or other collection service. Any reasonable recovery, legal, court, or collection costs incurred may be added to the outstanding balance where permitted by law.
3. Returns, Refunds & Warranty
Wizard House Pty Ltd complies with all obligations under Australian Consumer Law.
We do not offer refunds, exchanges, store credits, or returns for:
- Change of mind.
- Incorrect product selection by the customer.
- Products no longer required.
- Products ordered in error.
- Compatibility issues where advice was not sought before purchase.
Faulty products will be handled in accordance with Australian Consumer Law and applicable manufacturer warranty processes.
4. Special Orders & Custom Builds
Special order items, non-stock products, custom-built computers, configured systems, and products sourced specifically for a customer are non-refundable once ordered.
These products are purchased specifically for the customer and cannot generally be returned to suppliers.
Cancellation of special orders is at the sole discretion of management and may incur charges.
Deposits paid for special orders, custom builds, and configured systems are non-refundable except where required by Australian Consumer Law.
5. Data & Backup Responsibility
Customers are solely responsible for maintaining backups of all data stored on their devices.
While Wizard House Pty Ltd takes reasonable care when handling customer equipment, we do not guarantee the preservation or recovery of data.
Wizard House Pty Ltd accepts no responsibility for loss, corruption, damage, or recovery failure of data resulting from:
- Hardware failure.
- Software failure.
- Operating system reinstallation.
- Malware or virus removal.
- Warranty processing.
- Diagnostics or repair work.
- Manufacturer repairs or replacements.
Customers are strongly encouraged to maintain current backups before submitting equipment for service.
6. Repairs & Service Work
All repair and diagnostic work is performed on a best-efforts basis.
Quoted completion times are estimates only and may change due to parts availability, supplier delays, manufacturer requirements, unforeseen faults, or circumstances beyond our control.
Diagnostic, assessment, labour, and service fees may apply regardless of whether a repair proceeds.
Equipment not collected within a reasonable period after notification may incur storage fees where permitted by law.
Wizard House Pty Ltd reserves the right to refuse service for equipment that is unsafe, contaminated, illegally modified, or contains unlawful material.
7. Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts, or modifies any rights or remedies available to consumers under Australian Consumer Law.
Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law.
Where a product or service fails to meet a consumer guarantee, remedies will be provided in accordance with Australian Consumer Law.
8. Limitation of Liability
To the maximum extent permitted by law, Wizard House Pty Ltd shall not be liable for:
- Indirect or consequential loss.
- Loss of profits.
- Loss of business opportunities.
- Loss of revenue.
- Loss of data.
- Loss resulting from third-party software, hardware, internet services, or manufacturer actions.
Where liability cannot be excluded by law, liability is limited to the repair, replacement, re-supply, or refund of the relevant goods or services at the discretion of Wizard House Pty Ltd and as permitted by law.
9. Acceptance
By purchasing goods or services from Wizard House Pty Ltd, the customer acknowledges and agrees to these Terms & Conditions of Sale.
